Welcome to Let's Dink. By downloading, installing, or using the app, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.
1. Description of Service
Let's Dink is a mobile application that helps you organize casual pickleball pickup games with friends. The app allows you to create games, invite players, manage RSVPs, and coordinate game logistics. The service is provided free of charge.
2. Eligibility
You must be at least 13 years old to use Let's Dink. By using the app, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
3. Account and Authentication
Let's Dink uses Sign in with Apple for authentication. You are responsible for maintaining the security of your Apple ID. You agree to provide accurate information when creating your profile. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree to use the app only for its intended purpose of organizing pickleball games with people you know. You agree not to:
- Use the app for any unlawful purpose
- Harass, abuse, or threaten other users
- Impersonate another person or create false accounts
- Attempt to access other users' accounts or data
- Interfere with or disrupt the app's infrastructure
- Use the app to send unsolicited messages or spam
- Reverse-engineer, decompile, or disassemble the app
5. User Content
You retain ownership of any content you submit (profile photo, game details, messages). By using the app, you grant us a limited license to store and display this content as necessary to provide the service. You are solely responsible for content you submit and represent that you have the right to share it.
6. Intellectual Property
The app, including its design, code, graphics, and branding, is the property of Let's Dink and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the app without prior written permission.
7. Privacy
Your use of the app is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the app, you consent to the practices described in the Privacy Policy.
8. Third-Party Services
The app relies on Apple platform services including CloudKit, Sign in with Apple, Apple Push Notification service, MapKit, and EventKit. Your use of these services is subject to Apple's terms and conditions. We are not responsible for the availability or performance of Apple's services.
9. Disclaimers
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the app will be uninterrupted, error-free, or secure.
10. Assumption of Risk — Physical Activity
Let's Dink is a coordination tool only. We do not organize, supervise, or control any games or physical activities. By using the app to arrange or participate in pickleball games, you acknowledge and agree that:
- Pickleball and other physical activities carry inherent risks of injury, including but not limited to sprains, fractures, concussions, and other bodily harm
- You are solely responsible for assessing your own physical fitness and ability to participate safely
- We are not responsible for the condition, suitability, or safety of any venue, court, or location where games take place
- We are not responsible for the actions, conduct, or behavior of any other users or participants
- You voluntarily assume all risks associated with participating in games arranged through the app
You should consult a physician before engaging in physical activity if you have any health concerns.
11. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the app, regardless of the theory of liability. Our total cumulative liability to you for all claims arising from or related to the app shall not exceed the amount you paid to use the app (which is zero, as the app is free).
12. Indemnification
You agree to indemnify and hold harmless Let's Dink and its developers from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the app, your participation in games arranged through the app, or your violation of these Terms.
13. Account Deletion
You may delete your account at any time using the "Delete Account" option in the app's Settings screen. Deleting your account permanently removes your profile, game participation records, hosted games, and profile photo from our systems. You may also request account deletion by emailing us at the address below.
14. Modifications
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by updating the effective date. Your continued use of the app after changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the app.
15. Termination
We may suspend or terminate your access to the app at any time for violation of these Terms or for any other reason at our discretion. You may stop using the app at any time and delete your account as described in Section 13. Upon termination, your right to use the app ceases immediately.
16. Apple-Specific Terms
The app is distributed through the Apple App Store. You acknowledge and agree that:
- These Terms are between you and Let's Dink (Piyush Vyas), not Apple Inc. Let's Dink is solely responsible for the app and its content.
- Apple has no obligation to provide any maintenance or support services for the app.
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for any claims relating to the app, including product liability, consumer protection, or intellectual property claims.
- In the event of any third-party claim that the app infringes a third party's intellectual property rights, Let's Dink, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of such claim.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
17. Dispute Resolution
Any dispute arising from or relating to these Terms or the app shall first be attempted to be resolved through good-faith informal negotiation by contacting us at the email below. If the dispute cannot be resolved informally within 30 days, it shall be resolved exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States and the State of California, without regard to conflict of law principles.
19. General Provisions
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Let's Dink regarding your use of the app and supersede all prior agreements.
Waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
